Terms of service
The agreement
in plain words.
Last updated October 7, 2026. These terms apply to every Mind the Middle plan and project. By paying for a plan or submitting the onboarding form, you agree to them.
1. Who we are
Mind the Middle ("we," "us") is a database management and relationship marketing service operated by Savannah Rocca, based in Austin, Texas and San Diego, California. You can reach us at savannah@therealtyrundown.co.
2. What we provide
Monthly communication on your behalf (newsletters, informational emails, referral-partner emails, postcards and custom touches), optional database setup, and optional SmartPlan builds, as described on our Services page and agreed at your onboarding call. We write, design, load and schedule the content. You approve it before it goes out.
3. Plans, billing and price changes
- Plans are billed monthly in advance through Stripe on the date you sign up and on the same date each month after.
- Your card on file is charged automatically. You can update it any time through the receipt emails Stripe sends you.
- Postcard printing and postage are not included in any plan. They are billed separately at the printer's current rates (Real Mailers), which change when theirs do. The current rates are listed on our Services page.
- One-time projects (The Setup, SmartPlan builds, custom work) are quoted and paid before work begins.
- We may change plan prices with 30 days' written notice. Clients on a plan before a price change keep their rate until we tell you otherwise, with at least 30 days' notice.
4. Minimum term and cancellation
- Every plan has a three-month minimum from your first billing date.
- After three months, your plan continues month to month. Cancel any time with 30 days' written notice by email. You're billed for any month that starts inside the notice period.
- Pausing a plan is treated as a cancellation and restart; let us know and we'll work it out.
- Fees already paid are not refunded, except where the law requires it.
5. Approvals and the 48-hour rule
- Every piece is sent to you as a proof before it goes out, to the email on your onboarding form.
- You approve it, or send all your edits in one reply. One round of edits per piece is included. Additional rounds are billed at $40 per hour.
- If we do not hear back within 48 hours of sending a proof, it goes out as designed. This keeps your rhythm intact and is the only way we can hold send dates.
- Once a piece is sent or printed it cannot be recalled.
6. Your responsibilities
- Give us accurate contact, licensing and brokerage details, and tell us when they change.
- Review proofs for accuracy, including listing details, prices, dates and legal disclosures. We add required disclosures based on what you give us: the IABS notice for Texas licensees, and the DRE license number and broker identification California requires on marketing. You are the licensee and remain responsible for compliance with TREC, the California DRE, and your brokerage's advertising policies.
- Confirm that you have the right to contact the people in your database and that your use of their data complies with CAN-SPAM, the TCPA, and any other applicable law. Mind the Middle is not responsible for complaints arising from your list.
- If we send from your CRM, you authorize us to log in, load content, set audiences and schedule sends on your behalf, and you'll give us the access we need, including verification codes on send days.
- Tell us by the 28th of each month about any listings or changes you want in the next month's content if you don't use Command.
7. Your contacts stay yours
The people in your database are your contacts. We see them only while loading and sending your content. We never copy, export, keep, share, sell or distribute your contact list, and we never use your contacts for anything other than your own sends. When your plan ends, we have nothing of theirs to return because we never kept it.
8. Your content and your brand
You keep ownership of your name, logo, headshot, listings and any content you give us. You give us permission to use them in the pieces we make for you. We keep ownership of our templates, designs, layouts, copy frameworks and systems. The finished pieces are yours to send to your own database through our service; they may not be resold, redistributed or used to build a competing service.
9. Portfolio use
We may show pieces we made for you as examples of our work, with your personal contact details removed, unless you tell us in writing that you'd rather we didn't.
10. Third-party services
We rely on Stripe for payments, Tally and Google for forms and data storage, Canva for design, your CRM for sending, and Real Mailers for print and postage. Their outages, delays, delivery rates or price changes are outside our control. We'll always tell you when one affects your plan.
11. If something goes wrong
If we make a mistake, we'll fix it. To the extent the law allows, our total responsibility for any problem connected to this agreement is limited to one month of your plan fee. We can't be responsible for lost deals, lost commissions, or other indirect losses.
12. Indemnity
You agree to cover us for claims that arise from your database, your listings, your licensing status, or content you asked us to send, including advertising-rule or privacy complaints from your contacts.
13. Changes to these terms
We may update these terms. We'll post the new version here and email active clients at least 30 days before a material change takes effect. Continuing your plan after that date means you accept the new terms.
14. Governing law
These terms are governed by the laws of the State of Texas. Any dispute will be handled in the state or federal courts located in Travis County, Texas, and both of us agree to try to resolve it directly first. If you are a California client, nothing here takes away rights California law gives you that can't be waived.
